AGREEMENT CONCERNING LIMITED USE
BY USFJ OF
THE JAPAN MARITIME SELF DEFENSE FORCE
TATEGAMI FINGER PIERS
This agreement shall be concluded between representatives of the Japanese and United States Governments, based on the mutual consent of the U.S.-Japan Joint Committee on 12 December 1989. The following facilities shall be furnished to the U.S. Forces Japan (herein after referred to as USFJ) as additional facilities to U.S. Fleet Activities, Sasebo, FAC 5029 and granted use by USFJ under the provision of Article II4(b) of the Status of Forces Agreement:

The U. S. Government, by Memorandum FSUS - 686-3039 -DM (N) ,
Subject: Limited Use of JMSDF Facility at U.S. Fleet Activities, Sasebo, FAC 5029, dated 7 June 1989, requested to the Facilities Subcommittee, the limited use of the above facilities.
The Japanese Government, by MEMO No. 2711, Subject: Limited Use of JMSDF Facility at U.S. Fleet Activities, Sasebo, FAC 5029, dated 6 December 1989, to the U.S.-Japan Joint Committee, has concurred in the proposal for use of the JMSDF Tategami finger piers based upon the agreement made by the representatives of both the Japanese and U.S. Governments. And now therefore , the JMSDF Tategami finger piers are furnished for berthing of U.S. Ships under the following conditions.
1. Purpose
This agreement shall determine by JMSDF and USFJ the necessary matters for the limited use of the above facilities and areas (herein after referred to as the piers) .
2. Term of Agreement
This agreement will continue in effect until terminated by any of the following:
(a) By mutual consent of the signatories hereto.
(b) By either party upon 60 days written notice.
(c) By JMSDF for non-compliance by the USFJ with the terms of the agreement.
3. Application of Rules and Regulations
USFJ shall observe related articles of the SOFA, and of this agreement, and rules established by Commandant of Sasebo Regional Headquarters, JMSDF (herein after referred to as the Commandant) or his designated officials for the facilities and area, and items corresponding to these articles and rules.
4. Limited Use of Facilities and area
The limited use facilities and area are delineated in Addendum No.1 to this agreement.
5. Notice of Use and Coordination
(a) Commander, U.S. Fleet Activities, Sasebo (herein after referred to as the Commander) shall request use of the pier(s) to the Operations officer of JMSDF Sasebo Regional Headquarters (herein after referred to as the Operations Officer) at least 48 hours in advance to start of the use, providing relative information including term of use, outline of scope of fleet and so forth, and coordinate with the Operations Officer.
(b) When a schedule of U.S. Forces ship(s) (herein after referred to as the User) arrival and/or departure is changed more than one hour, the Commander shall promptly notify and coordinate with the Operations Officer on the change.
(c) When an urgent requirement of JMSDF occurs during the use of the berth(s) by the User, the User shall move and vacate the pier(s) within 12 hours if so requested by the Operations Officer.
(d) JMSDF will retain preferential use right of the piers.
6. Restrictions for Use of the Pier(s)
(a) When the User berths a ship(s) to the pier, the User shall pay attention not to disturb JMSDF ships operation.
(b) Ship berthing to the pier(s) shall be with the bow to the shore.
(c) JMSDF will not provide ship maneuvering support to the Use .
(d) When the User uses sonar and/or conducts diving operation, the Commander shall so notify in advance to the Operations Officer, and coordinate with him.
(e) When U.S. Forces drive heavy loaded truck and equipment onto the pier(s) and perform cargo loading and/or unloading operations, the Commander shall so notify in advance to the Operations Officer, and coordinate with him.
(f) Driving onto the pier(s) by privately owned vehicle is not authorized.
(g) USFJ shall be responsible for all the damages and accidents which occur due to the use of the pier(s) by the User.
7. Security
(a) The Commander shall be responsible for security of the User's ship(s) while the ship(s) is/are berthed to the pier.
(b) The Commander shall inform the Operations Officer of the methods of security for the ship(s) on berth(s) , by coordinating with him prior to use.
8. Fire Fighting
(a) The User shall be responsible for fire prevention and fire fighting operations for the ship(s) on berth.
(b) When fire broke out on the berthing ship(s) , U.S. Forces and/or JMSDF Ships, USFJ and JMSDF will mutually support the fire fighting operations.
9. Maintenance Control of Facilities and Areas
(a) Maintenance control of the piers will be accomplished by JMSDF .
(b) The Commander and the User shall pay full attention for use of the pier(s) and provide adequate control of facilities and area (s) .
(c) Upon request by the Commander, the Commandant shall provide utilities to the ship(s) on berth at the pertinent cost in accordance with Addendum No. 2 to this agreement.
(d) The Commander shall be responsible for disposal of refuse and waste materials to be generated by berthing ship(s) .
10. Revision of Agreement
(a) This agreement may be revised of amended as mutually agreed and within the scope and intent of the applicable Joint Committee agreement.
(b) When any questions of interpretation of this agreement arise, representatives of the both parties will coordinate and resolve the issues.
11. The Text of Agreement
This agreement shall be written in Japanese and English and constitute the authentic text. When a question arises on the provisions between the texts, the English version shall be the authorized text.

ADDENDUM NO. 2
TO
AGREEMENT CONCERNING LIMITED USE

TATEGAMI FINGER PIERS
This Addendum No. 2 is attached to the agreement concerning limited use by USFJ of the Japan Maritime Self Defense Force (JMSDF) Tategami finger piers, and forms a part of the agreement.
1. Electricity, Water and Steam Supply
(a) When the Commander desires to have electricity, water and steam supply to the berthing User's ship(s) , the Commander shall make coordination with the Operations Officer in advance.
(b) Supply will be suspended when trouble occurs on the supply systems while electricity, water and steam are being supplied .
(c) If accident occurs to the electrical supply system and causes power supply stoppage while electricity is being supplied to the User, the User must report to the Duty Officer, Sasebo Ship Repair Facility (herein after referred to as SRF Duty Officer) via the Commander and follow his direction. The User should not re-start use of electricity at his own judgment. Also if the accident is caused by User' use of electricity, the User shall immediately correct the trouble and report to the Duty Officer via the Commander, and wait his direction.
2. Electricity
(a) Each berth has one electrical distribution system with the capacity of less than 1,600 amperes.
(b) Since the total capacity of electricity for two berths is approximately 2 , 500 kilo watts, the Commander shall coordinate with the Operations Officer in advance to the start of use of electricity, and receive allocation of the amount of electricity available for use by the User.
(c) As to connection of cables to the outlets, the Commander shall prepare metal fittings and the User shall connect the cables to the outlets in the presence of JMSDF personnel in charge .
3. Water
(a) As to connection of water hoses to the outlets, the Commander shall prepare metal fittings and the User shall connect the hoses to the outlets in the presence of JMSDF personnel in charge .
4 . Steam
(a) As to connection of steam hoses to the outlets, the Commander shall prepare metal fittings and the User shall connect the hoses to the outlets in the presence of JMSDF personnel in charge.
5 . Communication
(a) The Commander may co-install communication cables in the utility trench for USFJ exclusive use after coordination with the Administrative Director, Commandant Sasebo District, JMSDF Headquarters (herein after referred to as Administrative Director) at the USFJ expense.
(b) The Commander may receive allocation 6f a maximum of two terminals at each JMSDF terminal box. after coordination with the Operations Officer during the limited use of the pier(s) . When, however, the JMSDF requirement for use of the terminal box allocated to the Commander arises due to increase in the communication terminal requirement, or an urgent requirement by JMSDF, the Commander shall immediately vacate the terminal. When the JMSDF requirement for use of the terminal is over, the Commander may again receive allocation of the terminals after coordination with
the Operations Officer.
(c) The communication cables for USFJ exclusive use shall be controlled by USFJ, and the Commander shall maintain them at the USFJ expense. When maintenance work is performed, advance coordination with the Administrative Director shall be made.
(d) When USFJ abolishes the limited use or receives a notice of revocation from the Japanese side, the Commander shall restore the site to the original conditions at the level of direction provided by the Administrative Director at the USFJ expense.
6. Determination of Electricity, Water and Steam Consumption
(a) When the User receives electricity, water and steam supply, the User shall connect shore extensions via meters to be prepared by the Commander to each berthing ship.
(b) Consumption of electricity, water and steam shall be determined by reading the meters in the presence of the JMSDF personnel in charge.
7. Billing Procedures
(a) Billing shall be made by the Accounting Director, Commandant of Sasebo Regional Headquarters , JMSDF to the Commander based on provision 9 (c) of the basic agreement.
(b) The billing account shall be closed out at the end of month, and payment shall be made based on the bill prepared by JMSDF by 15th of the following month in cash (Yen) .
(c) Computation of the costs for electricity, water and steam consumption shall be in accordance with attached sheets.

C: The actual electricity consumption by JMSDF at U.S. Fleet Activities, Sasebo, FAC 5029 during the previous Fiscal Year.
3 . Water

4 . Steam

5.Line Loss
The line loss factors shall be as follows:
Electricity 0.03 per cent
Water 0.02 per cent
Steam 0.10 per cent
The above factors may be revised.
