The operator of a chain of restaurants has sued Tokyo over an order to shorten operating hours as part of revised coronavirus measures.
飲食店チェーンの運営会社が、改正されたコロナウイルス対策の一環として出された営業時間を短縮するようにという命令をめぐって、東京都を訴えました。
Global Dining filed the lawsuit with the Tokyo District Court on Monday, claiming the order violates the Constitution and is illegal.
「グローバルダイニング」は月曜日に東京地方裁判所に訴えを起こし、その命令は憲法に違反していて違法であると主張しました。
The firm says it was ordered by the Tokyo government last Thursday to cut business hours at its 26 establishments in Tokyo.
その会社によれば、先週の木曜日に東京都から、都内の２６店舗で営業時間を短縮するように命令されたということです。
The government said the restaurants continued to operate after 8 p.m., increasing the risk of infection and possibly inducing other facilities to defy the request.
東京都は、それらの飲食店が午後８時以降も営業を続け、感染リスクを高めたり、ほかの飲食店が営業時間の短縮要請に従わないことを誘発したりするおそれがあると述べました。
Global Dining is seeking compensation, arguing the order violates the constitutionally guaranteed freedom of business.
「グローバルダイニング」は賠償を求めており、その命令は憲法で保障された営業の自由に反すると論じています。
A lawyer for Global Dining said there has been no review on whether the state of emergency was necessary. The lawyer added he hopes the lawsuit will help convey the voices of those affected by political decisions based on weak legal grounds.
「グローバルダイニング」の弁護士は、緊急事態が必要だったかについての検証がないと述べました。加えて、この訴訟を、薄弱な法的根拠に基づいた政治的決断によって影響を受けた人々の声を伝える一助にしたいと述べました。
